   Refund and Delivery Agreement

This Refund and Delivery Agreement is entered into between me, KandiXoXo, Content Creator and the Client/Customer/Buyer, which is you, on today's Date

1. Refund Policy

a. The Buyer acknowledges and agrees that once the Content is delivered by the Content Creator, no refunds will be provided.

b. If the Content Creator has already begun producing Custom Content for the Buyer, regardless if it has been delivered or not, no refunds will be issued. 

c. In the event that the Content Creator has not delivered the Content and has not started producing the Custom Content, the Buyer will be eligible for a refund.

2  Order Restriction:

a. If a refund is issued to the buyer as per the conditions mentioned in section 1c, the Content Creator will not accept any further orders from the Buyer.

b The Buyer acknowledges and agrees to this restriction and understands that it is a consequence of the refund.

3. Age Verification

a. The Buyer acknowledges and represents that they are 18 years of age or older at the time of entering into this Agreement.

b. The Buyer acknowledges that they are legally capable of entering into this Agreement and taking responsibility for their actions.

4. Custom Content Delivery

a. The Buyer acknowledges that all products/services offered by the Content Creator fall under the definition of Custom Content.

b. The Content Creator agrees to deliver the Custom Content within the period of no less than seven (7) Days and up to fourteen (14) Days, from the date of purchase, unless otherwise agreed upon in writing.

5. Reasons for Delivery Timeframe:

a. The Content Creator may require the specified timeframe for various reasons, including but not limited to workload, complexity of the requested Content, and ensuring the highest quality of the Custom Content.

b. The Buyer acknowledges and agrees to the specified delivery timeframe and understands that it is necessary for the Content Creator to provide the best possible product/service.

This Agreement constitutes the entire understanding between the Content Creator and the Buyer regarding refunds, delivery, and related matters

        CONTENT USAGE AGREEMENT 

This Content usage agreement is entered into between you, the Client/Customer/Buyer and me, KandiXoXo, the Content Creator on this date, the date that you, the Client/Customer/Buyer purchases Content from me 

1. OWNERSHIP & RIGHTS

a. The Content Creator retains all rights, title, and interest in the Content purchased by the Buyer, including but not limited to copyrights, trademarks, and any other intellectual property rights 

b. The Buyer acknowledges that they are purchasing a non-exclusive license to use the Content for Personal Use Only and do not acquire any ownership rights.

2  USAGE RESTRICTIONS

a. The buyer agrees NOT to post, publish, distribute, or share the purchased Content on any public or private platforms, including but not limited to the Internet, Social Media, websites, forums, or any other medium without the prior written consent of the Content Creator. 

b.  The Buyer shall not sublicense, sell, rent, lease, or otherwise transfer the Content to any third party without the explicit written permission of the Content Creator, KandiXoXo 

c. The Buyer shall not modify, alter, adapt, or create derivative works from the purchased Content without the explicit written permission of the Content Creator

3. CONFIDENTIALITY

a. The Buyer agrees to treat the purchased Content as confidential and shall not disclose, reveal, or make it available to any third party without the prior written consent of the Content Creator

b. The Buyer shall take reasonable measures to protect the confidentiality of the purchased Content, including but not limited to implementing appropriate security measures to prevent unauthorized access of distribution.

4. ENFORCEMENT AND REMEDIES

a. In the event of a breach of this Agreement by the Buyer, the Content Creator shall be entitled to seek injuctive relief, damages, or any other appropriate legal remedies. 

b. The Buyer acknowledges that any unauthorized use, distribution, or disclosure, of the purchased Content may result in irreparable harm to the Content Creator, for which monetary damages may not be an adequate remedy 

By purchasing the Content, the Buyer acknowledges that they have read, understood, and agreed to be bound by the terms and conditions of this Agreement.

Buyer's Acceptance of Term's and Conditions

By purchasing Custom Content from me, KandiXoXo, Content Creator, the Buyer acknowledges that they have read, understood, and agreed to be bound by the Term's and Conditions set forth in the Content Usage Agreement and the Refund and Delivery Agreement. The Buyer further acknowledges that their acceptence of these agreements is automatically implied and binding upon purchase of Custom Content
